Public Hearing:  Ordinance No. 2018-25.  An Ordinance amending and supplementing Section 1204.04   
(C)   (8)   of   the   Planning   and   Zoning   Code   to   update   regulations   for   wireless 
telecommunication facilities due to the passage of House Bill 478.

Vice  Mayor  Clark  opened  the  public  hearing  citing  the  purpose  and  procedure  of  the  
public hearing.

Having been sworn, Mr. Chesar presented the proposed change, as recommended by the Planning 
Commission, as it relates to small cell towers in the right-of-way.  The change allows these towers 
to be regulated through the right-of-way ordinance.  Mr. Chesar provided Council with an example of 
how staff proposes that the small cell towers should appear, which would be co-located on a black 
pole.

Mr. Frentzel asked if there are areas where these will potentially be located.  Mr. Chesar advised 
that there is interest now from an applicant to place one on Union Road.  He added that these could 
be located where there are dead zones or heavily used areas.

In response to a question from Mrs. McElfresh, Mr. Chesar explained that they could go on a Duke 
pole based on an agreement with Duke Energy.  Another option is the provider can request that they 
put up a pole and the City cannot really tell them no; however, if there is an existing pole 100 
feet away the provider must show why it cannot be located on that existing pole.  If it is a new 
pole the City will need to make sure it is as aesthetically pleasing as possible; preferably a 
metal black pole similar to a street light pole. The City will encourage that the service providers 
co-locate.

Mr.  Frentzel  asked  who  is  responsible  to  relocate  these  small  cell  towers  if  they  
need  moved because of road construction.  Mr. Chesar replied that he is currently looking into 
that.

There were no proponents or opponents.

Mr.  Hickman  moved  to  close  the  public  hearing;  seconded  by  Mrs.  McElfresh.   Voice  
vote.

Motion carried.
